Child Support

The statutory guidelines for child support are set forth in the Illinois Marriage and Dissolution of Marriage Act.  In general, the non-custodial parent is obligated for the following percentage of their net income:

                        20% for 1 child

                        28% for 2 children

                        32% for 3 children

                        40% for 4 children

                        50% for 5 or more children. 

The net income is the after tax income and may include deductions for union wages, health insurance and mandatory retirement.  However, no deductions are allowed for things such as non-mandatory retirement contributions or repayment of loans. 

The payor may also be obligated to provide health insurance and to pay a percentage of unreimbursed medical expenses; school registration; employment related day care and extracurricular activity expenses.   

It is important that if the situation of the payor changes (i.e. unemployment or reduction in income) that the payor petition the court immediately for a reduction in child support.  Regardless of income, the obligation of the payor remains constant until the petition for a reduction in child support is filed with the court.  A delay in the filing of the petition could potentially cost the payor a lot of money.

The child support applies whether the parties were married or if a parentage action is brought.
