Parentage /Paternity

When a child is born out of wedlock and the father wants to asset rights to the child or the mother wants to collect support, a Petition to Establish a Parent/Child Relationship must be filed. 

When an action has been filed against a ‘father’ that did not sign a Voluntary Acknowledgement of Paternity, the ‘father’ may request that a DNA test be done.  The test will often be at his expense, especially if he is determined to be the father of the child in question.  The father may also sign a voluntary acknowledgement of paternity.  In either case, once paternity is established, a judgment of paternity will be entered with the court. 

Once a father is established there are a number of factors that must be put into an order with the court.  The appropriate child support amount must be determined.  This will be done pursuant to the guidelines as laid out in the Illinois Marriage and Dissolution of Marriage Act.  Please refer to the section on child support for a discussion on the same.  The custody of the child must be determined and a visitation schedule developed.
